The reality star is in the midst of a really tough situation with her soon-to-be ex-husband Jason Hoppy because he wants custody of their 2-year-old daughter Brynn and so does Bethenny!

Bethenny Frankel is in a divorce war! The reality star’s estranged husband Jason Hoppy has filed his own divorce papers and now he wants the same things that Bethenny wants like: child support, medical bills paid, primary custody and more! HollywoodLife.com spoke with top divorce attorney Vikki Ziegler who tells us that Bethenny will have to prove a lot in court to win this battle.

What Bethenny Will Have To Do To Win Primary Custody

Bethenny filed for divorce and then Jason did. In his divorce papers he requested that 2-year-old Brynn be in his primary custody, that must be so heartbreaking for Bethenny.

“Bethenny will have to prove that she is a more fit parent and the best interest test will lie with her as the parent of primary residence not Hoppy,” Vikki tells us. “She will argue he should receive meaningful visitation but not make day-to-day decisions over the child. The court looks at who the ‘primary caretaker’ of the child is. The primary caretaker is the parent who spends the most time with the child, and is the parent the child first turns to if they need something. For example, the parent who feeds the child, takes to lessons, changes diapers, gets them dressed, and does other similar chores is probably the primary caretaker.”

Wow, this sounds like Bethenny has a lot to deal with!

Why This Divorce Could Get Ugly

Vikki goes on to say: “If the parties can’t get in a room with their lawyers and hammer out a deal, maybe a hybrid custodial arrangement and support package it may become one ugly court room battle. Life insurance is standard when one party pays the other child support because if the bread winner spouse dies so does the child support obligation … It’s a security to ensure that the child will always be cared for until emancipation in the event a party dies.”

Meanwhile Bethenny Has Been Seen Out With Another Man

We told you there was a report on RadarOnline.com that Bethenny had moved on with billionaire Warren Lichenstein. But it’s unclear if they’re dating!

When Bethenny filed for divorce she released this statement: “It brings me great sadness to say that Jason and I are separating. This was an extremely difficult decision that as a woman and a mother, I have to accept as the best choice for our family. We have love and respect for one another and will continue to amicably co-parent our daughter who is and will always remain our first priority,” the statement continues. “This is an immensely painful and heartbreaking time for us.”
